What A Takedown Notice Looks Like

"Blogger has been notified, according to the terms of the Digital Millennium Copyright Act (DMCA), that certain content in your blog is alleged to infringe upon the copyrights of others. As a result, we have reset the post(s) to "draft" status. (If we did not do so, we would be subject to a claim of copyright infringement, regardless of its merits. The URL(s) of the allegedly infringing post(s) may be found at the end of this message.) This means your post - and any images, links or other content - is not gone. You may edit the post to remove the offending content and republish, at which point the post in question will be visible to your readers again.

A bit of background: the DMCA is a United States copyright law that provides guidelines for online service provider liability in case of copyright infringement. If you believe you have the rights to post the content at issue here, you can file a counter-claim. For more information on our DMCA policy, including how to file a counter-claim, please see

The notice that we received, with any personally identifying information removed, will be posted online by a service called Chilling Effects at We do this in accordance with the Digital Millennium Copyright Act (DMCA). You can search for the DMCA notice associated with the removal of your content by going to the Chilling Effects search page at, and entering in the URL of the blog post that was removed. If it is brought to our attention that you have republished the post without removing the content/link in question, then we will delete your post and count it as a violation on your account. Repeated violations to our Terms of Service may result in further remedial action taken against your Blogger account including deleting your blog and/or terminating your account. If you have legal questions about this notification, you should retain your own legal counsel.

This Post Has No Glasvegas Links. None, Zero, Nada.

As I predicted, I received a bu11sh*t "DMCA Takedown Notice" for posting a video of Glasvegas. I guarantee you, the record label requests the takedown without reading or examining the content. I read about this happening with any blog that mentioned the band when their first album came out.
So, sorry Glasvegas, you get no exposure to new listeners from me. I can't see how posting a video that your record company posted legally under the username "glasvegasVEVO's Channel" is a bad thing for you in any way. The embedding option was not disabled at the time I reposted the video. As I type this, the share option is still providing code for Blogger.
In the end, I understand that Blogger is a free service and I make the choice to use it. Sony needs to look at the intent and the content!

Grats to Mogwai

The new Mogwai "Hardcore Will Never Die, But You Will" went in to the UK album charts today (Feb 20th) at number 25.
I have been listening to this one everyday and I seriously recommend it. It's a layered sound and I hear new sounds on each play. To their credit, this is an album I can listen to all by itself, all the way through. I don't get bored or feel like it's too heavy. Why are so many Scottish bands so brilliant?

Also of note: I added my last two podcasts to the server, so you can now download them directly, with no hassle. The right-side column of this blog has the links.

My Latest Podcast is Available

You can stream or download the mp3 (70.3 MB, 61 minutes) for free from zshare here.
I mixed this differently for this one. Instead of clumping genres in mini-sets, I spread the music-categories throughout the hour. So, for example: synthpop is heard at the beginning and then more post-punk bits and then back to some synthpop. I sacrifice any sort of mood-building, but I think arrangement will hold people's interest.

If you like at all, please leave me a comment. A simple hello keep me going at this. Alternatively, I can be reached at:

Eux Autres: new video "You're Alight"

I have followed this band (two members are brother and sister) since I saw them open-up for some act here in San Diego. I just adore everything they produce and have high hopes for their success. This track is particularly good, and a very nice introduction to their sound for new listeners. When I saw them live, Heather was singing and playing drums at the same time... that was impressive.

Det Vackra Livet - New Band on Sweden's Labrador (free .mp3)

I was going to save this for tomorrow, but I loved the song after one play... so I must post this now. Here's the blurb from Labrador Records: "We're very proud to announce that Det Vackra Livet - the best new band we've heard in ages - is now on Labrador! Yes, it's in Swedish, but don't let that scare you...
The duo consists of brothers Philip and Henrik Ekström who you might recognise from the band The Mary Onettes. Inspired by their grandmothers memoires and Swedish/Finnish poet Claes Andersson singer Philip wrote fifteen songs in a two months-creative outburst in the fall of 2010. The first single "Viljan" is out on iTunes now - you can of course download it for free from us. Enjoy!"

The Pains of Being Pure At Heart "Belong"

The Pains of Being Pure At Heart "Belong" by Slumberland Records

"They've enlisted the help of producer Flood (Smashing Pumpkins, U2, PJ Harvey) and ace mixer Alan Moulder (My Bloody Valentine, The Jesus & Mary Chain, Arctic Monkeys). The result is "Belong," a massive sounding album, sonically ambitious but still grounded in the peerless song-craft that The Pains are known for." Release date: March 15, 2011.
